1. The petitioner has filed the instant petition assailing the transfer order dated 14.11.2025 passed by the respondent by which the petitioner has been transferred from the Office of Deputy Commissioner, Cooperation Societies Ambikapur, District Sarguja to Under Secretary, Office of Chhattisgarh State Cooperation Election Commission, Raipur on deputation.

"That, it is further respectfully submitted by the answering respondent that the respondent authority has sent a letter to the Secretary, Co-operation Department, Ministry, Raipur, on 28.11.2025 regarding the proposal for upgradation of the post of Under Secretary to Deputy Commissioner. The process is now underway to provide an equivalent post in the office of the Chhattisgarh State Election Commission, Raipur. It is worth mentioning here that the service benefits, including salary and other facilities presently enjoyed by the petitioner, will not be altered. A copy of order dated 28.11.2025 is filed and annexed herewith as ANNEXURE R/1."
3. Considering the submission made by learned counsel for the State that service condition of the petitioner will not be adversely affected on transfer and also they have requested the State Government to upgrade the post, therefore at this juncture no writ of mandamus can be issued.
4. At this stage Learned counsel for the petitioner would submit that near the place of posting of the petitioner there are vacant posts available and would submit that he should be allowed to make representation.
5. Accordingly, the instant writ petition is disposed of. In the eventuality of filing of the representation, the concerned respondent is directed to consider and decide the same if post is available. Sd/- (Narendra Kumar Vyas) Judge Bhumika
