Heard learned AGA for the State and perused the record. 2. Present appeal has been filed against the judgement and order dated 17.2.1984 passed by 3rd Additional Sessions Judge, Shahjahanpur in session Trial No. 754 of 1982 whereby appellant has been convicted under section 302 IPC and sentenced to life imprisonment. Further prayer has been made to release the appellant in the aforementioned case during pendency of the present appeal. 3. Pursuant to order dated 8.5.2025, office has submitted its report dated 27.5.2025 based on the report of learned Chief Judicial Magistrate, Shahjahanpur dated 26.5.2025 according to which appellant Swami Dayal has died on 9.4.2024. Along with report, death certificate of appellant, statement of Ram Kumar Sub- Inspector, Brajnandan and Shiv Nandan Prasad, sons of appellant Swami Dayal and Pramod Kumar, Gram Pradhan have also been annexed. 4. Accordingly, appeal stands abated. 5. However, the record of present appeal shall remain connected with the connected appeal No. 504 of 1984.
