In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Techno India Police Station Case No.110 of 2020 dated 14.10.2020 under Sections 306/377/120B of the B.N.S. 2023. And In the matter of: Saddam Hossain. ...… Petitioner Ms. Rashmi Ghosh, Ms. Satabdi Das, .…For the Petitioner Mr. Iqbal Kabir, Mr. Atanu Ghosh, ….. for the State. 1. The submission made on behalf of the petitioner that this application has been filed for renewal of his prayer, which was rejected earlier. Consequently, thereafter the charge sheet has been submitted. He is in custody for 18 months. He was falsely implicated in this case. 2. Learned prosecution has raised objection and submits that the delay caused in completion of the investigation was due. Petitioner, who remained absconded for considerable period. and there is possibility to be further absconded, which would cause further delay in proceeding with the trial. 3. Perused the written complaint as well as the statement of various witnesses recorded under Sections 180 and 183 of the B.N.S.S. along with notice written by the deceased himself and the nature of allegation imposed upon the present petitioner. 4. Facts remains sufficient increminating materials available and the learned bench while refusing his earlier prayer requested
the learned Trial Court to abide by the trial at least to conclude the same as early as possible without granting any unnecessary adjournments to other of the parties. It is submitted that charge sheet has not yet been framed even though almost mine months has passed. Considering the facts and circumstances and the nature of allegation levelled against the present petition and the period of detention after he was arrested this Court is of the view that further detention is not required and the date is fixed for framing of charge by the learned Trial Court. 5. Accordingly, petitioner shall be released upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each one of whom must be local, to the satisfaction of the learned CJM, Barasat, 24- Parganas and on condition that he shall appear before the trial court on every date of hearing and shall not intimidate witnesses nor tamper with evidence in any manner whatsoever.
and on further condition that the petitioner shall not enter into the jurisdiction of the concerned Police Station until further orders and meet the I.O. of the concerned police station once in a week. 6. In the event the petitioner fails to appear before the trial court, the trial court shall be at liberty to cancel his bail bond without further reference to this Court before the jurisdictional Court on the dates fixed for appearance and in default, the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court
7. Thus, the application for bail in respect of petitioner is allowed. 2
8. Accordingly, the application being, CRM(M) 1665 of 2025 stands disposed of as allowed. 9. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 10.Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
