The petitioner has been made accused in connection with Bharno P.S. Case No. 46 of 2024 corresponding to Special POCSO Case No. 31 of 2024, for the offences registered under Section 64(1) of the B.N.S., 2023 and Section 4 and 6 of the POCSO Act, pending in the Court of learned Exclusive Special Judge POCSO-cum-Additional Sessions Judge-IV, Gumla. 3. On 23.08.2024, at about 11:00 p.m., the informant had gone outside his house to attend the call of nature. The petitioner caught hold of her and dragged her towards bushes and raped her. 4. It was submitted that the petitioner has been made accused due to previous enmity. It was further submitted that the prosecutrix has been examined and there is contradiction in her statement. 5. Mr. Sanjay Kumar Srivastava, learned A.P.P. has opposed the prayer for bail. 6. Considering the nature of allegation, I am not inclined to release the petitioner, on bail.
