The applicant- Mannoon Ahmad alias Babu is in judicial custody in Case Crime No.47 of 2025, registered at Police Station Pulbhatta, District Udham Singh Nagar under Section 3, Section 5 read with Section 11(1) of the Uttarakhand Protection of Cow Progeny Act, 2007. 3. As per the First Information Report, on a secret information, the police party raided the spot and recovered 12 kg of beef and other articles on 30.03.2025. The police party observed that there were 1 2025:UHC:3883 two persons on the spot. The police party arrested the present applicant, whereas co-accused Amil alias Guddu managed to escape from the spot. 4. Heard Mrs. Lata Negi, learned counsel for applicant and Mr. G.S. Sandhu, learned Additional Advocate General for State. 5. Mrs. Lata Negi, Advocate, contended that the applicant has been falsely implicated in the present matter. Despite sufficient time and opportunity, the police did not call any independent person as witness. Applicant does not have any criminal antecedents, and, he is in judicial custody since 31.03.2025. 6. Mr. G.S. Sandhu, learned Additional Advocate General, has opposed the bail application orally. 7. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage. 8. The Bail Application is allowed. 9.
