Neutral Citation No. - 2025:AHC:91585 Court No. - 80 Case :- APPLICATION U/S 529 BNSS No. - 1553 of 2025 Applicant :- Manvendra Singh Opposite Party :- State Of U.P. And 2 Others Counsel for Applicant :- Subhash Chandra Raghav Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. 1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Criminal Case No. 1168 of 2023 arising out of case crime no. 356 of 2022, under Sections 420 and 406 IPC Police Station- Govardhan, District- Mathura pending in the Court of learned Additional Civil Judge (S.D.)/ Additional Chief Judicial Magistrate, Court no.2, Mathura expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the informant in the said case. It is further submitted that the matter is very old and charges have been framed and the case is pending for prosecution evidence. It is fairly conceded that the present applicant is the informant of this case and he should be the first witness to be examined before the trial Court. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. Since the present applicant is the informant in this case and he has to be examined as P.W.1 but however instead of adducing his evidence before the trial Court for the reasons best known to the applicant, he approached this Court for a direction to the trial Court to record evidence in this case. 7. The application is misconceived and no direction requires in this matter. 8. The application, therefore, is rejected.
