Learned counsel for the respondent would submit that in pursuance of
order passed by this Court, the petitioner has been posted on his original post i.e. "Loading Inspector" which he was holding prior to passing of order dated 28.06.1995. He would further submit that if the BHUMIKA ANGARE Digitally signed by BHUMIKA ANGARE Date: 2025.12.12 17:20:27 +0530
2 petitioner intends to continue in higher post from the post of Loading Inspector, then he has to appear in the departmental examination conducted by the concerned department.
2. Considering the aforesaid submission made by learned counsel for the respondent, nothing is required to be adjudicated by this Court at this stage, therefore, the Contempt proceeding initiated against the respondents is closed.
3. Accordingly, this Contempt Petition is disposed of. The respondents are
directed to examine whether the examination can be waved as the petitioner stood retired long back, if the examination is necessary it shall be conducted within a period of three months from the date of receipt of copy of this order.
4. The petitioner is at liberty to revive the instant contempt petition, if
