Vijayalakshmi AND ...RESPONDENT(S) The State Of Andhra Pradesh and Others Counsel for the Petitioner:
1.M S P KAMARAJU Counsel for the Respondent(S):
1.GP FOR REVENUE (AP) The Court made the following order: The present writ petition is filed seeking a direction to the respondents not to interfere with petitioner’s peaceful possession and enjoyment of her land in an extent of Ac.3.12 cents in Sy.No.664 of Anantharajupet Revenue Vilalge fields of RIy. Kodur Mandal, YSR Kadapa District. Heard Sri M.S.P.Kamaraju,
learned counsel for the petitioner and
2. learned Assistant Government Pleader for Revenue appearing for the respondents.
It is contended that the petitioner has purchased the subject property
3. through a registered sale deed dated
07.10.2004. The husband of the petitioner's vendor had, in turn, purchased the subject property in the year 1957 from one Kamisetty Kondaiah, who in turn had purchased it from their vendor in 1936. The original purchase was made from Siddarapu Narasigadu in 1936, vide document dated 01.06.1936. In support of her contention, the petitioner relies on pattadar passbooks and title deeds. It is further contended that the revenue authorities, recognizing their title
4. and possession of the subject property, issued pattadar passbooks and title deeds, and their names are also reflected in the relevant revenue records. Thus, the petitioner contends that the respondents cannot interfere with their property in any manner. The 4*^ respondent filed counter affidavit, stating that the subject land is
5. categorized and classified as a "dotted land" in the revenue records. The Tahsildar issued a notice to the petitioner to appear on 24.09.2018. It is further contended by the revenue authorities that the subject land was identified and proposed for the issuance of house site pattas under the
“Navaratnalu Pedalandariki lllu” scheme, and proposals were submitted to the Revenue Divisional Officer for cancellation of earlier allotments, if any. In reply, the petitioner contends that they have already submitted a response to the show cause notice through their counsel. The petitioner
6.
further contends that the subject land has been enlisted in the list of prohibited properties under Section 22-A(1)(e) of the Registration Act, 1908. This Court, vide order dated 13.02.2020, passed interim direction not to dispossess the petitioner from the subject land.
7.
8. Considered the rival
submissions. To the notice dated 28.08.2018 issued by the Tahsildar, the petitioner has already submitted his explanation through counsel. It is noted that despite the submission of explanation, no further orders have been passed. The respondent-Tahsildar is therefore
directed to pass appropriate orders on the notice dated 28.08.2018, in accordance with law after considering the petitioner's explanation, submitted th through their counsel on
20.11.2019. Needless to observe that the 4 respondent shall afford due opportunity to the petitioner. Till passing of such orders, the petitioners shall not be dispossessed of the subject land.
9. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, all pending miscellaneous applications shall stand closed.
