Neutral Citation No. - 2025:AHC:85493 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5262 of 2025 Petitioner :- Modi Rubber Limited Respondent :- Shri Manoj Kumar Rana And 14 Others Counsel for Petitioner :- Tarun Agrawal Hon'ble Rohit Ranjan Agarwal,J. This is plaintiff's petition. It is contended that earlier Original Suit No.554 of 2005 was filed by the plaintiff-petitioner, which was decreed, against which, the defendant of that suit had preferred civil appeal, which was dismissed, against which a second appeal has been preferred before this Court, which is still pending in which no interim order has been granted. As the defendants were interfering in the possession of the petitioner, again an Original Suit No.581 of 2025 was preferred along with an application for grant of interim injunction in which only notices have been issued but the trial Court has not decided the same. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon trial Court to proceed with the interim injunction application filed on Original Suit No.581 of 2025 and decide the same in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
