Heard learned Advocate for the petitioner. 2. The petitioner has got converted the present petition from a Civil Writ Petition into a Criminal Writ Petition, by order dated 25.03.2025. 3. Learned Advocate for the petitioner, upon instructions, submits that the petitioner has instructed him not to press prayer clauses 'C' and 'D' and therefore, he is restricting the petition for prayer clause 'B'. 2025:BHC-AUG:15158-DB 2 criwp-479-2025 4. After making submissions and when the petitioner has been apprised of all the legal positions in the judgment of the Hon'ble Apex Court in the cases of Lalita Kumari Vs. Government of Uttar Pradesh and Ors., [AIR 2014 SC 187], Sakiri Vasu Vs. State of U.P. and Ors., [(2008) 2 SCC 409], Sudhir Bhaskarrao Tambe Vs. Hemant Yashwant Dhage and Ors., [(2016) 6 SCC 277] and M. Subramaniam and Ors. Vs. S. Janaki and Ors., [(2020) 16 SCC 728], learned Advocate for the petitioner, upon instructions, submits that he be allowed to withdraw the petition with liberty to approach the appropriate authority to lodge an F.I.R. 5.
