RP/SM MAT 61 of 2025 with CAN/1/2025 + CAN/2/2025
Hira Restaurant-cum-Bar and Anr. Vs. State of West Bengal and Ors.
Mr. Sayan Banerjee, Adv. Ms. Suparna Dutta, Adv. Mr. Rajat Biswas, Adv.
…For the Appellants
Mr. Debjit Mukherjee, Adv.
…For the Respondent Nos.2 & 3
1. This intra-court appeal filed by the appellant/writ petitioner is directed against the order dated 27th November, 2024, in WPA 26599 of 2024. The writ petition was filed seeking for restoration of the electricity connection which was disconnected. The learned Writ Court had elaborately heard the matter, took note of Clause 13.9 of the West Bengal Electricity Regulatory Commission (Standard of Performance of Licensees relating to Consumer Service) Regulations, 2010 as well as Clause 3.4.2 of the West Bengal Electricity Regulatory Commission (Electric Supply Code) Regulations, 2013 and has thoroughly analysed the factual situation and has recorded a finding that there is clear nexus between the petitioner No.2 and her husband’s brother who was impleaded as private respondent. The appellant/writ petitioner was not able
2 to establish before the court that the bar-cum- restaurant run by the second petitioner is run in the different premises. This factual finding could not be dislodged in this appeal as well.
2. Therefore, we find no grounds to interfere with the impugned order. The appeal fails. The appeal and the connected applications are, accordingly, dismissed.
