1. Heard Sri Vijai Kumar Singh, learned Senior Counsel assisted by Sri Ashutosh Mishra, learned Counsel for the petitioner and Sri Ayub Khan,
learned counsel for respondent no. 4/1, Sri Jawahar Lal Yadav, learned counsel for respondent no. 5/1 and Sri Pankaj Kumar, learned Standing Counsel for the State. 2. Brief facts of the case are that petitioner along with proforma respondents are chak holder no. 70 of the plots situated in Village- Maliksepur, Pergana-Nizamabad, Tehsil-Sadar, District-Azamgarh. Respondent no. 4/Hadisunnisa was chak holder no. 120. Respondent no. 5/Smt. Akhtarunnisa was chak holder no. 9. Against the proposal of Assistant Consolidation Officer chak objections were filed by tenure holders under Section 20 of the U.P.C.H. Act. Consolidation Officer decided the chak objection vide common order dated 24.04.1982 increasing the number of petitioner's chak from two to three as well as reducing the area of petitioner's original plot no. 280. In chak appeal filed by petitioner along with his brother, the chak of the petitioner was further disturbed vide order dated 25.05.1982. Petitioner along with his brother filed revision under Section 48 of the U.P.C.H. Act which was allowed by Deputy Director of Consolidation vide order dated 16.09.1982. Against the order dated 16.09.1982 passed by the Deputy Director of Consolidation, Azamgarh, the restoration application was filed on behalf of the respondent no. 4 and Deputy Director of Consolidation vide subsequent order dated 23.03.1984 reviewed the earlier order dated
16.09.1982. Hence this writ petition for following reliefs:-
"1) to issue a writ of certiorari quashing the order of opposite party no. 1 dated 23.03.1984. 2) to quash the order of opposite party no. 2 and 3 respectively dated 24.02.1982 and 25.05.1982. 3) to issue any other order writ or direction which under the circumstances of the case it is deemed fit and proper. 4) to award cost of the writ petition to the petitioner. "
3. This Court admitted the writ petition on 12.04.1984 and stayed the dispossession of the petitioner from the dispute land. 4. In pursuance of the order dated 12.04.1984 parties have exchanged their affidavits. 5. Learned Senior Counsel for the petitioner submitted that Consolidation Courts have no power to review the order/judgment passed on merit in view of the ratio of law laid down of this Court in full Bench decision reported in 1997 RD 562 Smt. Shivraji (Deceased by LR's) v. Deputy Deputy Director of Consolidation, Allahabad and others (F.B.).
He further submitted that vide order dated 16.09.1982 the petitioner was adjusted on his original plot which was proper compliance of Section 19 of the U.P.C.H. Act, as such the final order was passed by the Deputy Director of Consolidation dated 16.09.1982 cannot be set aside/recalled/modified by revisional Court himself. 6. On the other hand, Sri Ayub Khan, learned counsel appearing for private respondent submitted that the private respondents were not afforded proper opportunity while deciding the revision as such the restoration application was filed on behalf of private respondents. He further submitted that the Deputy Director of Consolidation has recalled the earlier order and decided the revision vide subsequent order dated 23.03.1984 by which both parties have been adjusted in proper manner, as such no interference is required against the impugned order passed by the Deputy Director of Consolidation in allotment of chak proceeding. 7. I have considered the arguments advanced by the learned counsel for the parties and perused the records. 8. There is no dispute about the fact that chak allotment proceeding was decided by Deputy Director of Consolidation on merit exercising revisional jurisdiction vide order dated 16.09.1982, but on the restoration application filed by private respondent, the earlier order was recalled and subsequent order was passed on 23.03.1984 reviewing the earlier order dated 16.09.1982. 9.

The perusal of the order dated 16.09.1982 as quoted above fully demonstrates that order was passed on merit by Deputy Director of Consolidation affording full opportunity of hearing to the parties in Court as well as on spot. The full Bench of this Court in Smt. Shivraji (Supra) has held the Consolidation Courts have no power to review their
order/judgment passed on merit. It is also material to that mention under the earlier order dated 16.09.1982, the petitioner was adjusted on his original plot, as such there was no occasion to file restoration application against the order dated 16.09.1982 passed on merit.
11. Considering the entire facts and circumstances of the case, the impugned order dated 23.03.1984 passed by respondent no.1/Deputy Director of Consolidation is liable to be set aside and same is hereby set aside.
12. The writ petition stands allowed and the order dated 16.09.1982 passed by respondent no.1/ Deputy Director of Consolidation is hereby affirmed.
13. No order as to costs.
