CONCILIATION ORDER The petitioner, retired employee of the Corporation, is before this Court seeking a writ of mandamus directing the respondents/Corporation to pay interest at the rate of 14% per annum on the belated payment of terminal benefits, namely leave encashment. 2. The parties to the lis have amicably resolved their dispute before the Lok Adalat and to that effect, they have filed joint memo of settlement. The terms of settlement read as under: a. The Management, though disputing the order, has agreed to pay interest at 6% per annum on the belated payment of leave encashment benefits for the period of delay, within eight weeks from the date of receipt of the certified copy of the award, which the petitioner has accepted. b. It is further agreed that in the event of failure to pay the said interest within eight
3 week, the respondent-Corporation shall pay interest at 9% per annum on the belated payment. c. If the Management fails to comply with the aforesaid conditions, the petitioner is at liberty to initiate appropriate proceedings before the competent Court of law for execution of this settlement.
d. The above settlement and the terms agreed upon are in accordance with law, do not offend any provision of law, and constitute a fair and reasonable settlement in the interest of both parties. 3. The joint memo of settlement is placed on record. In terms of joint memo, the respondent/Management is directed to pay interest at 6% per annum on the belated payment of leave encashment benefits for the period of delay, within eight weeks from the date of receipt of certified copy of the award. If the respondent/Management fails to pay interest at the rate of 6% per annum within eight weeks, the respondent/Management is liable to pay interest at 9% per annum on the belated payment. If
4 the respondent/Management fails to comply the above said direction, the petitioner would be at liberty to initiate appropriate proceedings for execution of settlement or to initiate contempt proceedings. 4. Accordingly, in terms of joint memo, the petition stands disposed of. Sd/- JUDGE
