Heard Mr. Shaleen Singh Baghel, learned Deputy Government Advocate, appearing for the State/applicants and Ms. Aditi Singhvi, learned counsel for the respondents. 2. The present MCC has been filed for extension of time in compliance of the the directions of the Court’s order dated 05.12.2024 passed in WPCR No.474 of 2024 with the following prayer :- “It is therefore prayed that this Hon’ble Court may kindly be pleased to allow the application of the applicants/State and further may kindly be pleased to grant 3 months more time from today in compliance of the directions of the Hon’ble Court dated 05.12.2024 passed by the Division Bench of this Hon’ble Court in WPCR No.474/2024, D.K. Soni Vs. State of Chhattisgarh and 4 Others, in the interest of justice.” 3. Perusal of the record would show that this Court, vide order dated 05.12.2024 passed in WPCR No.474 of 2024, while disposing off the writ petition to the petitioner, namely, D.K. Soni, had expressed its trust that the Investigating Officer would make an earnest endeavor to 3 conclude the investigation within a period of six weeks from the date of passing of the order and to submit the Police Report under Section 173(2) of Cr.P.C. (now under Section 193(3) of BNSS) before the competent Court in accordance with law. 4. Considering the pleadings made in the present MCC, it transpires that as per the directions of the Superintendent of Police, District Balrampur-Ramanujganj, the Station House Officer, Police Station Balrampur District Balrampur- Ramanujganj vide its order dated 31.12.2024 had constituted a SIT headed by the Additional Superintendent of Police, District Balrampur-Ramanujganj (CG) alongwith 7 police personnel to further investigate the crime bearing Crime No. 08/2023 dated 02/08/2023 so that after due investigation, appropriate charge sheet would be presented before the competent Court as per the provisions of Section 173(2) of the Cr.P.C. 5. It further transpires from the record that the matter is pending investigation with the SIT and during investigation, the SIT had recorded the statements of the witnesses in furtherance to the investigation done by the Investigating Officer of the crime under Section 161 of Cr.P.C. and had also made correspondence with the Divisional Forest Officer, District Balrampur- Ramanujganj as also seized certain documents. 6. Taking into account the fact that the matter is under investigation and will consume some more time for filing the charge sheet as the documents/vouchers by which the alleged payment was made in the present crime is to be recovered from the possession of the Office of the 4 Accountant General, Chhattisgarh as the same were deposited by the Divisional Forest Officer District Balrampur- Ramanujganj with the said Office as per letter dated 30.12.2024. It is thus crystal clear that the applicants have tried their level best in complying with the order passed by this Court, but in the present case, the investigation is going on and will consume some more time, as such, they prayed that further 3 months’ time may be granted. 7. The request appears to be reasonable. The concerned authorities are directed to conclude the trial as early as possible, preferably within a period of two months from today. 8.
