1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to call for the entire records from the possession of
2 the Respnodent Bank in relation to the home loan secured by the petitioner’s father and the amount already paid back by the petitioner and his as per Loan Agreement father and the outstanding amount left to be recovered by the Bank. 10.2 That, this Hon’ble Court may kindly be pleased to issue appropriate writ(s)/order(s)/direction(s) directing the Respondent Bank to refrain from sending any further recovery notices to the petitioner and thereby refrain from harassing him 10.3 Cost of the petition may also be granted to the petitioner. 10.4 Any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner, in the interest of justice.”

Learned counsel for the Respondents raises an objection with regard to the maintainability of the writ petition on the ground that the respondent has already filed an application before the Debt Recovery Tribunal for recovery of the loan amount from the petitioner in which, the petitioner is also noticed. Copy of the notice is also enclosed along with the writ petition. The proceedings before the Debt Recovery Tribunal is still pending consideration and if the petitioner is having grievance, he can file appropriate application before the Debt Recovery Tribunal. 3.
Learned counsel for the petitioner do not dispute the submission of counsel for the respondent/Bank with respect to filing of the proceedings by the respondent/Bank before the Debt Recovery Tribunal and issuance of notice to the petitioner. 4. In the aforementioned facts of the case, parallel proceedings is not permissible when, the respondent/Bank has already availed the remedy available under the law in which, the petitioner is also party and therefore, I am not inclined to entertain this writ petition. Accordingly, it is dismissed reserving liberty with the petitioner to approach the Debt Recovery Tribunal by filing appropriate proceedings for redressal of his grievance as raised in this writ petition. 3
