This application under Section 529 BNSS has been filed with a prayer to direct the A.C.J.M., Shikohabad, Firozabad to decide the Complaint No. 2233 of 2014, under Sections 12, 18, 19, 20, 21, 22 Protection of Women from Domestic Violence Act, Police Station Sirsaganj, District Firozabad expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the present case has been filed under the Domestic Violence Act and the applicant is the wife of opposite party no.2 and is aggrieved lady. It is further submitted that no interim maintenance has been granted so far in favour of the applicant and she is suffering from financial hardship and mental agony and is not in a position to attend the Court for the pairvi of the case on each and every date. It is also submitted that the Court concerned is not taking proper interest to decide the case. Applicant is a lady and she has a legal and constitutional right for speedy trial. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the entire record. 6. It is very surprising that a case under the Domestic Violence Act, which is a special enactment for the protection of the rights of women from domestic violence and has a specific object and scope, was filed in the year 2014 but the trial court is not taking any interest to decide the same and the case is pending for the last 11 years. It is a very sorry state of affairs on the part of the trial court. 7. In the circumstances, the Court concerned is strictly directed to decide the aforesaid case within two months from the date of production of certified copy of this order before, if there is no legal impediment. 8. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 9.
