The petitioner was married to the respondent according to Hindu Rites and Customs in the year 2021. A matrimonial dispute arose between the parties which led to the parties living separately. A petition under Section 13-B of Hindu Marriage Act was filed on 22.12.2022 before the Principal Judge, Family Court, Ghazipur for the divorce by mutual consent, which is registered as Matrimonial Case No.849 of 2022 and the same is pending consideration. The sole prayer made in the writ petitioner is for expeditious disposal of the said matrimonial case. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the respondent, the matter is being disposed of, at the admission stage, with a direction upon Principal Judge, Family Court, Ghazipur to decide the Matrimonial Case No.849 of 2022 filed under Section 13-B of Hindu Marriage Act, after hearing both the parties, strictly in accordance with law expeditiously preferably within a period of three months from the date of production of certified copy of this order, in the light of the decision of Hon'ble Apex Court rendered in case of Amardeep Singh vs. Harveen Kaur (2017) 8 SCC 746.
