(Oral) Applicant Madan Bhandari is in judicial custody in FIR No. 289 of 2019, under Sections 302, 307, 504 & 506 IPC and Section 30 of the Arms Act, 1959, Police Station Nanakmatta, District Udham Singh Nagar. He has sought his release on bail. 2. This is fourth bail application of the applicant. His first bail application, second bail application and third bail application have been rejected on 29.06.2022, 13.06.2023 and 08.05.2024, respectively. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant submits that the applicant has already undergone 5 years and 7 months custody; out of 36 prosecution witnesses, only 18 witnesses have been examined; there are less chances of completion of trial in near future. 5. Learned State Counsel admits these facts. 6. Having considered the period of incarceration, which the applicant has undergone and other attending factors, this Court is of 2 the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
