This Criminal Petition, under Sect-Ion 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking anticiPatOry bail, in connection With Crime No.156 of 2024 of Hindupur Rural Police Station, Sri Sathya Sai d'IStriCt. 2. A case has been registered against the Petitioner herein and others for the offences punishable under Sect'IOnS 318(4), 337, 336(3) of the Bharat'lya Nyaya Sanhita, 2023 (for short lthe BNS'). Subsequently, during the COurSe Of investigation, POliCe added sect'lon 338 of the BNS. 3. Case of the Prosecution, in brief, iS that Prior tO o8.07.2024, A1, who was working aS VRO in Tahsildar Office, H-lndupuram, issued forged enjoyment Certificates With the help of Hindupuram Mandal Surveyor to the de faCtO COmPlainant and 18 others in Survey No.13-G2B2B and got registrations in the sub-Reg'IStrar Offilce by taking br'lbe Of Rs.1,40,000/-from them in a fraudulent manner and cheated them. 4. Heard. Perused the record. -+i-, 5. ln the remand report of A1, A2 and A6, it has been categorically mentioned as follows. llBasing on the confession of Al and A2, it is clearly established that Al to A6 wer; criminally conspired each other and intentionally created fake documents to the said land and sold out the same to the innocenis by taking money from them". Except the said confessional statement of Al and A2, there is no other material to connect the petitioner herein to the present crime. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein/A3 on-the following conditions. i) ln the event of arrest of the petitioner herein/A3 in the above crime, he shall be enlarged on bail on h`iS executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioner shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to ```--r`--`S 3 \o i dissuade h®Im from disclosing such facts tO the Court or to any pol'lce officer. iii) petitioner shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 AM and 01.00 PM till filing of charge sheet. 7. Accordingly, the Criminal Petition is allowed. As a sequel thereto, the miscellaneous Petitions, if any, pending in this criminal petition shall stand closed.
