By way of this petition, the petitioners have prayed for following reliefs:- “10.1 Hon'ble Court may kindly be direct to respondents to grant the regular salary & further direct the respondents to release the pending salary of the petitioners with interest. 10.2 Hon'ble Court may kindly be direct to respondents to not to do 3-3 months extension & at least to be extend for 11 months. 10.3 Hon'ble Court may kindly be direct to respondents to contribute for Employees Provident Fund (EPF), Gratuity and also direct the respondents/employer to contribute at a specified rate to Employees State Insurance Corporation as per Scheme. 26 10.4 Hon'ble Court may kindly be direct to respondents to issue salary slip and also direct not to deduct the TDS or in an alternative issue TDS certificate. 10.5 grant any other writ/ writs, order/ orders, relief/ reliefs in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioners.” 2. Brief facts of the case, is that, the Information & Communication Technology (ICT) Scheme, issued by the Ministry of Education, Government of India, comprises four essential components: partnership with State Governments and Union Territories for providing computer-aided education in Secondary and Higher Secondary Government Schools; establishment of SMART schools as technology demonstrators; universalisation of computer literacy through the network of KVS and NVS to neighbouring schools; and activities of SIETS. Under the CLASS component of the ICT Scheme, the Union Government provides 75% financial assistance to the States/UTs, while the remaining 25% is contributed by the State Governments/UTs, with an option to utilise 25% funds from MPLAD in addition or as an alternative to the State’s share. The Department of School Education, Government of Chhattisgarh, under its Digital Vision, is taking measures to improve the teaching-learning experience through a technology-enabled environment by establishing Digital 27 Classrooms and Computer Labs to enhance academic standards and efficiency. Samagra Shiksha has conceptualised a project to equip 4,330 government schools with technological infrastructure, pursuant to which an agreement was executed on 11.06.2019 between the Mission Director, Samagra Shiksha, Raipur, and Bennett Coleman & Company Limited. The petitioners were appointed as School Coordinators, Computer Instructors, and Digi Mitras at various Government Schools under the Digi Duniya Project. The Digi Mitras were appointed between August 2022 and October 2022 for three months, with periodic extensions, while the School Coordinators and Computer Instructors were appointed in February 2020 for one year including a three-year probation period, which they successfully completed and thereafter their services were periodically extended. Although appointed at a monthly remuneration of Rs. 9,000/- (inclusive of tax), the petitioners are being paid only Rs. 7,500/-. As the respondents employ more than 200 persons, all earning below Rs. 10,000/-, the petitioners are eligible for EPF, however, the respondents have not deducted or contributed EPF. The scheme is for five years, yet after the initial one-year appointment, the respondents extended services only for three-month periods, which is being misused to threaten the petitioners with non-renewal if they assert their legal rights. The respondents have been deducting TDS from salaries without issuing TDS certificates or salary slips. Salaries are not released on time and are often delayed by two to three 28 months, and the petitioners have not received salary from January 2023 till date. Under the Employees State Insurance Corporation Scheme, employees earning less than Rs. 21,000/- are mandatorily covered, with contributions of 3.25% by the employer and 0.75% by the employee; however, the respondents neither contributed their share nor deducted the employees’ share, rendering the petitioners ineligible for ESI benefits due to no fault of their own. The Ministry of Education has also issued guidelines regarding ICT Labs, Smart Classrooms, and TABS sanctions. In the State of Jharkhand, ICT instructors under the same project receive higher salaries and are duly provided EPF, ESI, and gratuity benefits, whereas in Chhattisgarh no such contributions are made. Some petitioners have submitted representations before the Collector, Balod, and the District Education Officers of Balod and Dantewada regarding non-payment of salary, leading to the filing of the present petition. 3. Learned counsel for the petitioners submits that the Information & Communication Technology Scheme issued by the Ministry of Education, Government of India clearly outlines a comprehensive framework involving multiple components, implementation partners, and defined financial parameters for enhancing technology-enabled education in government schools, and pursuant to this scheme an agreement dated 11.06.2019 was executed between the Mission Director, Samagra Shiksha, Raipur and Bennett Coleman & Company Ltd. for equipping 4,330 29 schools with digital infrastructure, the petitioners were duly appointed as School Coordinators, Computer Instructors and Digi Mitras to undertake essential functions such as training teachers, assisting students, managing ICT labs and digital classrooms, and providing troubleshooting support, however, despite their appointments, successful completion of probation and continuous extensions of service, the respondents are paying them reduced remuneration, withholding EPF and ESI benefits though statutorily applicable, irregularly releasing their salaries, failing to issue TDS certificates and salary slips, and arbitrarily extending their contracts for short periods to suppress their rightful claims, which is discriminatory, exploitative, contrary to the scheme guidelines, and violative of statutory mandates and principles of fairness, compelling the petitioners to approach this Hon’ble Court for redressal. 4. On the other hand learned counsel for respondent Nos. 2 and 5 submits that the Information and Communication Technology (ICT) Scheme, launched by the Government of India, is a centrally sponsored scheme with 60% central funding and 40% state funding, for which the Central Government has issued comprehensive guidelines and an implementation framework that has been periodically amended to meet evolving requirements. It is submitted that under clause 3.1.2 of the said framework, the answering respondents have been designated as the implementing agency and vested with the authority to engage 30 private organizations for effective execution of the scheme in the State. Exercising these powers, the respondents issued a Request for Proposal (RFP) for supply and commissioning of digital teaching-learning resources and hardware for digital classrooms, wherein Chapter VII and clause (b) specifically provide that deployment of manpower is the sole responsibility of the bidder/vendor. Pursuant to the RFP, M/s Bennett Coleman & Co. Ltd., along with its consortium partner (private respondent No. 6), was found eligible and was accordingly awarded the contract, followed by execution of a formal agreement. Clause 8(viii) of the agreement clearly stipulates that all manpower engagement is the exclusive responsibility of the vendor, and any dispute relating thereto is strictly between the vendor and its employees, with the department having no role or liability. The manpower deployed by the vendor is engaged only to train teachers in operating ICT equipment and maintaining installed systems, and their duties are not akin to those of regular teachers. Since the petitioners were appointed solely by the vendor/private respondent No. 6 and not by the answering respondents, issues relating to wages, minimum wages, tenure, or service conditions do not concern the answering respondents. It is thus evident that the respondents’ role is limited to overseeing the implementation of the ICT Scheme, and all responsibilities regarding manpower engagement lie with the contractor; therefore, the petition filed against the answering respondents is devoid of merit and liable to be dismissed at the 31 threshold. 5. I have heard learned counsel for the parties and perused the material available on record. 6. The High Court of Delhi in the matter of Asulal Loya vs. Union of India and others reported in 2008 SCC Online Del 838 wherein learned Single Judge arrived at the same conclusion, while dealing with a writ petition filed against the Bharat Aluminium Company Limited (BALCO) in the year 1991 and decided in 2008 i.e., post-privatization of BALCO in 2001. The relevant portions from the said judgment as relied upon are extracted hereinbelow:- “3. It is fairly well settled that a writ petition is not maintainable against a private limited company or a public limited company in which the State does not exercise all pervasive control. In Binny Limited vs. V. Sadasivan, reported in (2005) 6 SCC 657, the Supreme Court has held that a writ petition under Article 226 of the Constitution is normally issued against public authorities and can also be issued against private authorities whey they are discharging public functions and the decision which is sought to be corrected or enforced must be in discharge of a public function. In the present case, the issues and questions involved do not relate to public functions. 10. In these circumstances, the present writ petition is dismissed without going into the merits of the matter 32 upholding the preliminary objection raised by the respondent company that it is not a State and, therefore, not amenable to writ jurisdiction. It is, however, observed that the petitioner is at liberty to approach any forum for redressal of his grievance, if so advised and the time spent by him in these proceedings shall be taken into consideration for the purpose of limitation. In the facts and circumstances of the case, there will be no order as to costs.” 7. In view of the admitted facts, it is evident that the petitioners are employees of respondent No. 5, a private vendor engaged under a contractual arrangement for the supply and commissioning of Digital Teaching–Learning Resources and hardware for Digital Classrooms under the ICT @ Schools Scheme for 4,330 Government schools in Chhattisgarh. As per Clause 8(VIII) of the agreement dated 11th June 2019, the responsibility for engagement and management of manpower rests solely with the vendor, and no element of public employment or statutory obligation is attributable to the State in this regard. Respondent No. 5, being a private entity, is not amenable to the writ jurisdiction of this Court, and in light of the authoritative pronouncement of the Hon’ble Supreme Court in Phoenix ARC Private Limited v. Vishwa Bharati Vidya Mandir reported in (2022) 5 SCC 345, a writ petition is not maintainable against a private party in the absence of any statutory duty. Consequently, this Court finds no 33 ground to exercise its extraordinary jurisdiction and, therefore, the writ petition deserves to be and is hereby dismissed. 8. The petitioners are at liberty to file appropriate application before the appropriate forum for redressal of their grievance in respect of remuneration/salary which they have not been paid.
