THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR JUSTICE ANANT RAMANATH HEGDE)
This petition is filed under Articles 226 and 227 of the Constitution of India by the petitioners, assailing the order dated 27.03.2024 passed in Civil Miscellaneous No.2/2022 on the file of Principal Civil Judge, Hubballi.
2. The Trial Court allowed the miscellaneous petition and set aside the order dismissing the suit for non- prosecution.
3. The ground urged before this Court is that the petitioners were not heard before restoring the suit in the said miscellaneous petition. It is the submission of the
learned counsel for the petitioners that the notice to the petitioners was dispensed with, and without issuing such notice, the order was passed only by hearing the
submissions of the petitioners’ father.

4. Learned counsel for the respondents submits that the petitioners’ father and the petitioners filed a common written statement, as such no prejudice is caused.
5. This Court has considered the contentions raised by the Bar and perused the records.
6. It is indeed true that notice was not issued to the petitioners while passing the order. Ideally, such notice ought to have been issued. However, it is also noticed that the petitioners’ father was represented, and all of them have filed a common written statement. There is no conflict between the father and the sons.
7. Under these circumstances, notwithstanding the fact that the notice was not issued to the petitioners, this Court is of the view that no prejudice is caused to them. Apart from that, the order which has been set aside, is only an order dismissing the suit for non-prosecution.

8. Under the circumstances, the Court does not intend to interfere in the said order in exercise of jurisdiction under Article 227 of the Constitution of India.
9. Accordingly, the writ petition is dismissed.
