This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Complaint Case No.155 of 2024 pending in the Court of Additional Civil Judge (S.D.)-IInd/ A.C.J.M. Gautam Buddh Nagar expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the application of the applicant filed under Section 156 (3) Cr.P.C. was treated as a complaint case by the learned trial Court. It is further submitted that evidence under Section 200 and 202 Cr.P.C. has already been recorded and the case is pending for passing the summoning order since 12.11.2024 and only dates are being fixed, this creating a delay in the proceeding and disposal of the case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the entire record. 6. In view of the above, the Court concerned is directed to pass suitable order on the point of summoning in the matter in accordance with law preferably within two months from the date of production of certified copy of this order before it, and if opposite party no.2, the accused, is summoned to face trial, all endeavours shall be made for expeditious disposal of the case, if there is no legal impediment. 7.
