Order No.03
Date: 24.03.2025
1. The present writ petition has been filed for issuance of direction upon the concerned respondent i.e. respondent no.4 to make online entry of the land appertaining to Mouja Balardih, Mouja No.284, Khata no.98 (new Khata no.105), plot no.783 (new plot no.1461), measuring an area of 40 decimals in the official portal of the Government of Jharkhand maintaining the records of land as well as for issuance of continuous Khatiyan of the said land in the name of the petitioner.
2.
Learned counsel for the petitioner submits that the aforesaid land was purchased by the petitioner through registered sale deed no.1709/1329 dated 15th April, 2015. Thereafter, she applied for mutation of the said land in her name before the respondent no.4, which was registered as Mutation Case No.89(xii) of 2014-15, which, after due enquiry, was allowed in her favour and, accordingly, her name was entered in the Register-II by creating Jamabandi No.466 with respect to the said land. The petitioner
thereafter also paid rent for the said land to the Government till the year 2015-16. 3. It is further submitted that since the year 2016 a new process has been initiated by the State Government, as per which only online rent receipts are being issued to the concerned raiyats. Since the name of the petitioner with respect to the said land has not been entered in the concerned official portal of the Government of Jharkhand, she is not in position to pay the rent. Moreover, since the name of the petitioner with respect to the said land has already been entered in Register-II in terms with the order passed in Mutation Case No.89(xii) of 2014-15, she represented the respondent no.4 for issuance of continuous Khatiyan of the said land in her name, a copy of which has been annexed as Annexure-4 to the writ petition. The grievance of the petitioner is that despite representing the respondent no.4 in this regard, no action has been taken by the said respondent, compelling her to file the present writ petition. 4. Learned AC to AAG-III appearing on behalf of the respondents submits that if the petitioner prefers a fresh representation on the present issue before the respondent no.4, an appropriate decision/step will be taken within a timeframe. 5. Having heard learned counsel for the parties and considering the nature of the prayer made in the writ petition, without entering into merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent

no.4. On receipt of the said representation, the respondent no.4 after verifying the relevant records and on providing opportunity of hearing to the petitioner as well as other concerned parties (if no needed), shall take an informed decision/step within a period of eight weeks from the date of filing of the representation. 6.
The writ petition is, accordingly, disposed of with the aforesaid liberty and direction. (Rajesh Shankar, J.) Sanjay/
