1. Heard on I.A. No.01/2024, for condonation of delay in filing the petition.
2. On due consideration and finding the reasons mentioned in the application to be satisfactory, I.A. No.01 is allowed and the delay of 37 days in filing the petition/appeal stands condoned.
3. Also heard on admission.
4. Admit.
5. This application under Section 378(4) read with Section 372 of CrPC has been filed seeking for grant of leave to appeal against the judgment of acquittal dated 07.03.2024 passed by the Additional Sessions Judge, Dongargarh, District Rajnandgaon (CG) in Criminal Appeal No.02/2024 whereby the appeal preferred by respondent/accused Gopal Khemuka against the judgment dated 11.12.2023 passed by the ACJM, Dongargarh in Complaint/Criminal Case No.64/2015 has been allowed and the respondent Gopal Khemuka has been acquitted of the charge under Section 500 of IPC.
6. Considering the facts and circumstances of the case, this Court is of the opinion that arguable points have been raised by the petitioner for grant of leave to appeal.
7. Accordingly, the application seeking leave to appeal is allowed. Leave as prayed for is granted.
8. Let this CRMP now be registered as an Acquittal Appeal.
9. After registration as an acquittal appeal, let notice be issued to the respondents No.1 to 3, on payment of PF within 7 working days. Sd/- (Sanjay Kumar Jaiswal) JUDGE
