GP FOR FINANCE PLANNING The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.3203 of 2025 ORDER: The present Writ Petition is filed seeking for the following relief: “to declare the action of the respondents in not releasing the bill amounts admittedly due to the petitioner despite successful completion of works in terms of the Agreement No 72/20232024 dated 25-09-2023 with the Measurement Book MBook No. 53/20232024 for the work executed by the petitioner namely Pulivendula Municipality PADA Grants 2023-2024-Laying of CC Road from Bakarapuram Sachivalayam to Gangi Reddy Hospital in Bakarapuram Sachivalayam of Pulivendula Municipality under the Pulivendula Area Development Agency PADA grant works approved for payment and entered in the CFMS Comprehensive Financial Management System even after completion of defect liability period and inspite of repeated requests as illegal, arbitrary, discriminatory, unjust enrichment violative of Articles 14, 19 and 21 of the Constitution of India apart from being contrary to the orders of this Honourable Court issued from time to time and consequently direct the Respondents to forthwith pay the approved amounts payable to the petitioner in respect of the works executed by the petitioner under the aforesaid agreement along with interest accrued on the said amounts from the due date till the date of payment”. 3 2. When the matter is taken up for hearing, learned Standing Counsel appearing for the Respondent No.4 has produced the instructions submitted by the Commissioner, wherein it was mentioned at para No.5 that the petitioner has executed the work entrusted to him and the measurements were recorded in M-Book and bills were raised for gross amount of Rs.30,04,805/- and net amount of Rs.26,74,035/- was uploaded in CFMS Portal with the token number 2024-282107 and are waiting for fund clearance. It was further mentioned that the amount would be released in favour of the Petitioner on receipt of necessary funds. 3. Considering the Written Instructions submitted by the learned Standing Counsel, the Writ Petition is disposed of granting four months time to the respondent authorities to make payment to the Petitioner. There shall be no order as to costs.
