Neutral Citation No. - 2025:AHC:84106 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5229 of 2025 Petitioner :- Aman And 3 Others Respondent :- Swami Jagveer Counsel for Petitioner :- Prateek Rai,Satya Prakash Rai Counsel for Respondent :- Vidya Prakash Singh Hon'ble Rohit Ranjan Agarwal,J. 1. This is defendants' petition. In the suit instituted by the plaintiff- respondent an application for grant of temporary injunction was moved which was partly allowed to the extent of directing the parties to maintain status quo. Against the order of status quo, the respondent had preferred Civil Misc. Appeal 19 of 2025, which was heard on admission and the order of status quo directing the parties to manage the affairs of temple was stayed till the next date and till the pendency of the appeal, plaintiff was directed to look into the management of the temple. 2. The hearing in the appeal is going on. This Court finds that the petition is premature as the misc. civil appeal is still pending consideration. However, looking to the fact of the case that the trial Court had passed the order of status quo, requiring both the parties to maintain management of the temple during pendency of the suit, I find that no interference is required in the said order. The order passed by District Judge, Ghaziabad dated 08.4.2025 is modified to the extent that parties to maintain status quo over the property in dispute till the appeal is decided. 3. The District Judge, Ghaziabad is hereby requested to proceed with the appeal and decide the same within a period of two months from the date of production of a certified copy of this order, after hearing all the affected parties, in accordance with law and till then, the order of status quo as granted by the trial Court, shall continue. 4. The writ petition stands disposed of. Order Date :- 20.5.2025 Kushal Digitally signed by :- KUSHAL AGRAWAL High Court of Judicature at Allahabad
