HIGH COURT OF JUDICATURE AT ALLAHABAD TRANSFER APPLICATION (CRIMINAL) No. - 253 of 2025 Court No. - 81 HON'BLE MANOJ BAJAJ, J. Applicant- Rajat Jain Alias Chirag Jain has filed this application under Section 447 Bhartiya Nagrik Suraksha Sanhita, 2023 seeking transfer the proceeding of Case No.51 of 2025, under Section 144 of B.N.S.S., 2023, titled Sonal Jain Vs. Rajat Jain, pending in the court of Principal Judge, Family Court Meerut to District Saharanpur. Learned counsel for applicant has argued that the opposite party no.2-wife has filed maintenance case against the applicant at Meerut, whereas divorce petition, under Section 13(1) Hindu Marriage Act, 1955 filed by husband- applicant is pending at Saharanpur. Learned counsel submits that since the mother of the applicant is old, who is having age related health issues, therefore, it is inconvenient for the husband-applicant to contest the case at Meerut. Learned counsel prays that it would be in the interest of justice, if, the criminal case pending at Meerut is transferred to Saharanpur, as it would be convenient for the applicant to pursue the said case. During the course of hearing, it is not disputed by learned counsel for the applicant that the minor son of the parties residing with the mother is only two years old, and the wife is residing with her parents at Meerut. Since, the nature of the proceedings of the maintenance case may not consume much time for final adjudication, therefore, the sole ground of convenience raised by the applicant is not sufficient for transfer of the said case. Versus Counsel for Applicant(s) : Prashant Sharma, Sanjay Kumar Srivastava Counsel for Opposite Party(s) : G.A.
