This writ petition has been filed with the following prayer:- "1. Issue appropriate order or direction, directing the tried Court below to decide the application for interim custody of his children (paper no. 32(Ga)) on the date fixed or expeditiously within a time period stipulated by this Hon'ble Court." It is contended that in the proceedings instituted under Sections 7/8/9/24/25 of the Guardians and Wards Act, 1890 read with Section 6/13 of Hindu Minority and Guardianship Act 1956 for retaining the custody of the child, an application for interim custody of the children has been moved which is registered as Paper No.32-Ga and the sole prayer made in the writ petition is for expeditious disposal of the same. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the sole respondent, the matter is being disposed of, at the admission stage, with a direction upon Court below to decide the application for interim custody of the children registered as Paper No.32-Ga, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
