Neutral Citation No. - 2025:AHC:32939-DB Court No. - 29 Case :- WRIT - C No. - 1205 of 2025 Petitioner :- Ashutosh Singh Gautam Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Mohitosh Singh Counsel for Respondent :- C.S.C.,Rameshwar Prasad Shukla Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. It is alleged that certain persons have made encroachment over the land in question. None of those who allegedly have encroached the land is impleaded as a respondent. Even otherwise, if encroachment is on the State land, remedy would be before the competent authority under Section 67 of the U.P. Revenue Code, 2006. Otherwise, if the encroachment is on private land, remedy would be before the competent civil court. In that view of the matter, filing of the writ petition is utterly misconceived and is accordingly dismissed.
