Learned counsel for the petitioner would submit that he may be allowed withdraw the present writ petition with liberty to prefer appeal before the Divisional Level Committee constituted by the State with regard to his transfer.
3. Prayer is allowed.
4. The appellate authority before hearing the appeal on merit will consider whether the petitioner has joined the service or not.
5. Accordingly, the writ petition is disposed of with aforesaid liberty granted in favour of the petitioner.
