Sri Shahbaz Khan, learned counsel for the applicant on instructions submits that though the application under Section 528 of BNSS has been preferred by the applicant for quashing the entire criminal proceedings of Complaint Case No. 972 of 2023, and also quash the summoning order dated 11.04.2023 passed by Learned Court of Learned Civil Judge (J.D) / Judicial Magistrate Sambhal, under Section 138 N.I Act. Police Station Sambhal District Sambhal, pending in the Court of Learned Civil Judge (J.D) / Judicial Magistrate Sambhal, however, he confines his relief for enlargement of bail before the court below. 2. Learned A.G.A. has no objection to the same. 3. Considering the submissions raised at the Bar and the statements so sought to be made by them, the application stands disposed of while observing that in case appropriate proceeding in the form of bail application is preferred before the court below, then the same shall be decided with most expedition strictly in accordance with the law of the land keeping in view the judgment in the case of Satender Kumar Antil Vs.
