Item No. 4 01.12.2025 Court. No. 6 GB C.O. 3565 of 2025 Debasree Saha Vs. Subhasish De Sarkar Mr. Jayanta Narayan Chatterjee, Sr. Adv., Ms. Paromita Mukhopadhyay, Ms. Moumita Pandit, Ms. Ilora Pandit … for the Petitioner. Mr. Souma Subhra Ray, Ms. Neelam Kumari, Ms. Archana Baghel … for the Opposite Party. 1. Considering the rival contentions and the well-being of the child, the order impugned requires to be modified. 2. By the order dated August 8, 2025, passed in Misc. Case No. 83 of 2024 (Act-VIII), the learned Additional District Judge, Fast Track, 5th Court, North 24 Parganas at Barasat, directed the petitioner to make arrangements so that the opposite party can meet the minor child twice a week in the evening, preferably between 5 p.m to 7 p.m at Eco Park, Kolkata. 3. Submission is made by Mr. Chatterjee, learned senior advocate for the petitioner that the place of meeting is not congenial for a 8 year old child. The place is quite deserted in the evenings and especially during winters. Moreover, between 5 p.m. to 7 p.m. the child has to concentrate on her homework and tuitions. 4. Under such circumstances, and upon considering the packed schedule of the child, her extracurricular 2 activities, her engagement in the evenings at tuitions, etc., the meetings shall be permitted on Sundays, for time being. 5. Thus, the father will be entitled to meet the child every Sunday at Eco Park and/or Axis Mall as per the preference of the child for that week, between 12 to 3 p.m. Such visit will include entertainment, games, joy rides, amusements and lunch. The wife/petitioner shall ensure that such visitation operates smoothly and she will ensure that the child is handed over to the father on each and every Sunday during the time mentioned. Prior to such visit, the parties will decide on the venue, through their respective learned advocates. The father will have dedicated time alone with the child and the parties shall refrain from discussing about each 0ther with the child. Visitation will start from the coming Sunday, i.e., on 07.12.2025. The arrangement will continue till further orders are passed by the learned Court. 6. Accordingly, the revisional application is disposed of. 7. Parties are to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
