Present applicant ‘Dinesh, son of Shri Rajpal Thakur’ is praying for regular bail in relation to First Information Report dated 09.07.2024 bearing FIR No. 294 of 2024, Police Station – Kotwali Dehradun, District – Dehradun wherein present applicant is implicated for the offence punishable under Section 64, 352 BNS and under Section 3 (kha) (gha) / 4 of the POCSO Act. 4. Learned counsel for the applicant submits that present applicant is innocent and has been falsely implicated. She further submits that charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and the applicant is languishing in jail since 10.07.2024. She further submits that applicant suffered long incarceration and there are multiple contradictions in the statement of the victim as well as about her age. 5. On the other side, learned State Counsel have not disputed this fact that charge-sheet has been filed, therefore, there is no need of custodial interrogation and the applicant is languishing in jail since 10.07.2024. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration that charge-sheet has been filed, therefore, there is no need of custodial interrogation and the applicant is languishing in jail since 10.07.2024, therefore, this Court is 2025:UHC:5931 of the view that applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘‘‘Dinesh, son of late Shri Rajpal Thakur’” be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
