Mr. Kh. Samarjit, learned DSGI, assisted by Mr. Nongdamba, learned counsel, appears for the Union of India and Mr. H. Debendra, learned Deputy Advocate General assisted by Mr. Dimal Kumar Haobam, learned counsel, appears for the State respondents. The learned Deputy Advocate General would submit that the petitioners have not submitted the passports for consideration of their application for deportation to Myanmar and the learned DSGI appearing for the Central Government would also state that if the passports are available with the petitioners the same should be submitted to the State authority and the State authority shall consider and take appropriate decision to deport the petitioners to Myanmar. But, in the present case, since the passports are not submitted by the petitioners to the State authority, the State Government cannot consider the application for deportation of the petitioners to Myanmar. In the light of the submission made by the respondents, we are of the view that the petitioners should submit their application along with passports to the respondent within a period of 4 (four) weeks from the date of receipt of the
order. On such receipt of such application along with the passports, the respondent has to consider the application and take appropriate action for their deportation to their home country (Myanmar) in accordance with law as early as possible without any delay. With the above direction the writ petition is disposed of. Copy of the order be communicated to the petitioners through the Superintendent of Police, Manipur Central Jail, Sajiwa for necessary compliance.
