ORDER 10.02.2025 Learned counsel for the petitioner has contended that the respondent has executed a document “Tehrir Nama” by virtue of which he had agreed to return the cheques which are subject matter of the impugned complaint as such, he could not have filed the impugned complaint against the petitioner. The veracity of the aforesaid contention urged by the petitioner for impugning the subject complaint cannot be determined by the Court in these proceedings, as the same involves determination of disputed questions of fact. In view of the above, the petition is dismissed leaving it open to the petitioner to urge the aforesaid ground before the trial Magistrate at the appropriate stage.
