Apprehending his arrest in connection with Nagar Untari P.S. Case No.174 of 2024 instituted under Sections 74, 109, 118(1), 126(2), 303(2), 352, 3(5) of the B.N.S., 2023, the petitioner has moved this Court for grant of privileges of anticipatory bail. It has been averred in the petition of the instant anticipatory bail application that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons were forcibly ploughing the land of the informant with intention to grab the land and when the wife of the informant and others forbade him, the petitioner assaulted the wife of the informant with intention to kill her and outraged the modesty of Nazma Khatoon. It is next averred that the allegation against the petitioner is false. It is contended in the anticipatory bail application that the petitioner and informant are relatives and there is land dispute between them, hence, this false case has been foisted. It is next averred that the allegations against the petitioner are general and omnibus in nature. It is next averred that there is no specific allegation against the petitioner of assaulting the wife of the informant and outraged the modesty of the Nazma Khatoon. It is next averred that, from the side of the petitioner, Nagar Untari P.S. Case No.177 of 2024 has been instituted by Anwar Ansari for the self-same occurrence. It is next averred that there was free fight between the parties. It is further averred in para-15 of the instant bail application that the petitioner has no criminal antecedent. It is also averred that the petitioner is ready and willing to abide by any terms and conditions imposed upon him by this Court. Considering the facts and circumstances of the case, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.10,000/- as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nagar Untari, Garhwa in connection with Nagar Untari P.S. Case No.174 of 2024 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of the case and he will not annoy or disturb the informant in any manner during the pendency of the case and subject to the conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
