ELEVATED AS JUDGE The Court made the following: ORDER:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the notification issued by the 4th respondent Choultry, dt. 01-10-2016 in proposing to conduct auction of the land which is in the possession of the petitioner an extent of Ac.5-50 cents out of total extent of Ac.27-05 cents covered by Sy.No.245 of Tyajampudi Village, Devarapalli Mandal, East Godavari District to be held on 15.10.2016 as arbitrary, illegal, null and void against the principles of natural justice and contrary to explanation II of Sec.82 (2) of A.P. Charitable and Hindu 2 Religious Institutions and Endowments Act, 1987 (Act 30 of 1987) as amended Act 33 of 2007 and consequently direct the respondents to allow the petitioner to continue to cultivate the lands in his possession by fixing rent and to pass .…” 2. Heard Ms. M.L.Neelima, learned counsel for the petitioner and the learned Government Pleader for Endowments appearing for the respondents. 3. As seen from the proceeding sheet, on 14.10.2016, this Court has granted any interim order directing the respondents to permit the petitioner to participate in the auction if the petitioner fulfils the auction conditions. 4. Thereafter, the respondents have also filed their counters. However, on perusal of the counter affidavit, it is observed that the lease period is for the year 2016-2019. As the lease period has already lapsed by 2019 itself, no cause survives in the Writ Petition at present and it may be closed. 5. Recording the said submission, this Writ Petition is closed. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed. __________________________ Dr. K.
