p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK CONTC No.6323 of 2025 Abhishek Parida …. Petitioner Mr. S.S. Patra, Adv. -Versus- Dr. Thirumala Naik, IAS- Commissioner-cum-Secretary, Govt. of Odisha School & Mass Education Dept., Bhubaneswar & others …. Opposite Parties Ms. Suman Pattanayak, AGA CORAM: JUSTICE KRISHNA S. DIXIT Order No. 04. ORDER 11.05.2026 The complaint alleges violation of the final order dated 21.08.2025, whereby complainant’s WP(C) No.17335 of 2024 was disposed off granting relief. As would happen in this State, unless contempt proceedings are taken the Government and its functionaries do not comply with the Court orders, compliance being an exception non-compliance being the rule. That will not augur well to the Court of law which is one of the basic features of the Constitution of India vide Kesavananda Bharati v. State of Kerla, AIR 1973 SC 1461. 2. Be that above as it is, now the contemnors have passed Order No. 6343 dated 08.05.2024 vide letter No.SME-LEGAL2- LEGAL1-0919-2025-11976/SME complying with the order of this Court. There is enormous delay in compliance. Therefore, the complainant, who is in the cadre of Clerk was asked as to whether he would forgive the contemnor IAS officer for the act of non- compliance of the Court order and he graciously has forgiven the contemnor subject to the rider that all financial benefits accruing p. 2 from the order should reach his hand within seven working days. With this proposal, learned AGA defending the contemnor is agreeable. Since, citizen himself has excused the IAS officer, who has violated the Court order and now has complied with the Court order with enormous delay, this Court also forgives him with a warning that in the event financial benefits that have been undertaken to be paid to the complainant do not reach his hand, that would be an act of aggravated contempt, for which he can take separate proceedings. With the above observations, proceedings are dropped with liberty as indicated above. Web copy of order to be acted upon by all concerned. (Krishna S.
