Accordingly, all these case are being disposed of by a common order. 3. The petitioners have been made accused in connection with Poraiyahat P.S. Case No. 130/2024, for the offence registered under Section 70(1) of the B.N.S. 2023 and Sections 4 & 6 of the POCSO Act, pending in the Court of learned Addl. Sessions Judge-1-cum- Special Judge (POCSO), Godda & Learned Addl. District & Sessions Judge-1st Class, Godda. 4. On 25.10.2024, the petitioner Jitender Baski @ Jitendra Baski accompanied the victim and told that he would take to her village. In the meantime, 12 to 13 persons intercepted them and took the victim to an isolated place where she was raped by 12 to 13 accused persons. 5. Learned counsel appearing on behalf of the petitioner Jitender Baski @ Jitendra Baski submitted that there is no allegation against this petitioner that he had raped the victim. Learned counsel appearing on behalf of the other petitioners submitted that the victim has not taken the name of the petitioners in her statement recorded under Section 183 of the B.N.S.S., 2023. 6. Learned A.P.Ps. appearing on behalf of the State have submitted that the petitioners were identified in the T.I.P. It was further submitted that the petitioner Jitender Baski @ Jitendra Baski had enticed away the victim and handed over to the accused persons. 7. Considering the nature of allegation, I am not inclined to release the petitioners, on bail. Accordingly, their prayers for bail stand rejected. (Ambuj Nath, J.) Rahul/-
