1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.319/2016 registered at Police Station Balod for the offence punishable under Sections 420, 467, 468, 471, 406/34 Of I.P.C. & Sec. 3, 4, 5 of Inami Chit-Fund & Prize Money Circulation (Prohibition) Act, Sec. 10 of Protection of Depositors Interest Act. Case of the prosecution, in brief, is that complainant namely Ashok Kumar Sahu lodged written report to police station on 24-07-2016, that he was allured by the agent of Divyani Properties in the year 2014 for double the amount. Based on that assurance the complainant had deposited 9 lacks Rs. with the company against which he was issued bond papers, but when he demanded his money from the directors of the company namely Rajesh Singh, Rajkumar. Dhruv kumar, Ramesh Choudhary & Vipin Singh they refuse to return the money of the complainant. Thereby, the instant F.I.R. was lodged U/s 420, 467, 468, 471, 406/34 Of L.P.C. & Sec. 3, 4, 5 of Inami Chit-Fund & Prize Money Circulation (Prohibition) act, & Sec. 10 of Protection of Depositors Interest act was lodged.

Learned counsel for the applicant submits that the co-accused namely Ramesh Choudhary has been granted bail by the coordinate bench of this Court in MCRC No.3220/2019 on 22/07/2019. He would submit that the applicant is in jail since 28/09/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant.

On the other hand, learned State Counsel opposes the bail application and submits that the case pertains to the year 2016 and case was registered against the applicant on 3/09/2016, applicant was absconding at the time when the charge sheet was filed against the co- accused and a supplementary charge sheet has been filed against the applicant on 3/11/2025 and the applicant is named in the FIR and further he has one more criminal antecedent, therefore he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case

Considering the fact that the applicant has been absconding and he was arrested by the police on 28/09/2025 and thereafter supplementary charge sheet has been filed against the applicant on 3/11/2025, therefore, this Court is not inclined to grant bail to the applicant as there is every likelihood that the applicant would abscond, if he is granted bail.

Accordingly, the bail application of applicant Rajesh Singh involved in Crime No.319/2016 registered at Police Station Balod for the offence punishable under Sections 420, 467, 468, 471, 406/34 Of I.P.C. & Sec. 3, 4, 5 of Inami Chit-Fund & Prize Money Circulation (Prohibition) Act, Sec. 10 of Protection of Depositors Interest Act, is rejected.
8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
