The present application has been preferred for the following relief(s): i) for commanding and direction upon the respondents authorities to remove of encroachment made by respondent no. 7 over the land of the purchased land of the petitioner whereas and whereunder said land has already been purchased by the petitioner from the respondent no. 7 through registered sale deed no. 12933 dated 01.11.2006 situated at Mauza-Gaddopur, Thana No. Patna High Court CWJC No.7951 of 2025(2) dt.12-05-2026 2/3 104, appertaining Old Khata No. 200, New Khata No. 152, Old Khesra No. 103, New Khesra No. 984 Measuring Area of 0.65 Decimal under boundary North Alauddin, South - Md. Sagar Ali, East - Md. Matin, West - Koraisa Khatoon under Anchal Tajpur, District Samastipur. (ii) For commanding and direction upon the respondent authorities for demarcation of said land of the petitioner appertaining old khata no. 200, new khata no. 152, old khesra no. 103, new khesra no. 984 an area of 0.65 decimal at Mauza - Gaddopur, Thana No. 104 under Anchal Tajpur, District Samastipur with taking help from the Officer-In-Charge, Police Station Bangra, District Samastipur. At the outset, learned State Counsel submits that the petitioner is trying to seek remedy against the respondent no. 7, a private respondent in the garb of removal of encroachment instead of moving before an appropriate authority/Competent Civil Court.
