Though no reply has been filed on behalf of respondents, but the prayer made in the application has been opposed vehemently on the ground that day-to-day delay, as required to be explained under law, has not been explained. Taking into consideration averments made in the application and submission made by learned counsel for the parties, delay of 161 days in filing the appeal is condoned. Appeal be registered. FAO No. …. of 2025 (FAOST No. 3187 of 2025) Learned counsel for the applicant/appellant submits that loss of dependency has been assessed as 11,000/- and, therefore, amount of compensation was to be ₹ calculated by taking multiplicand of 7334/- after deducting ₹ 1/3rd amount towards personal expenses, but the compensation has been calculated by applying multiplicand of 9,000/- and in case amount of compensation is determined by ₹ applying multiplicand of 7334/-, appellant shall be satisfied. ₹ Learned counsel for the respondents/claimants seeks time to have instructions.
