Chaturvedy, Advocate For the State : Mr. Fahad Allam, A.P.P. --------- Order No.06/ Dated 25th April, 2025 1. Petitioner is apprehending his arrest in connection with Rajpur P.S. Case No.42 of 2024, for the offences registered under Section 305(e) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate First Class, Chatra. 2. Learned counsel for the petitioner very fairly conceded the fact that on earlier occasion, anticipatory bail application of this petitioner has already been rejected by this Court in ABA No.6394 of 2024 vide order dated 15th October 2024, but at the same breath, he pointed out that other similarly situated co-accused persons have already been admitted to anticipatory bail by Coordinate Bench in ABA No.6314 of 2024 vide order dated 11.11.2024 and in ABA No.6605 of 2024 vide order dated 18.11.2024. 3. He further pointed out that confessional statement of co-accused Rohit Dangi and Lokesh Kumar clearly suggest that the entire recovery has been affected and this fact has not been brought to notice of the Court at the time of hearing of A.B.A. No. 6394 of 2024. 4. Learned APP for the State opposed the anticipatory bail by submitting that there is no fresh ground to reconsider the same. 5. When query was made to the learned APP that what volume / length of LT wire has been stolen, then he very fairly conceded that it is not clear from the material available in the case diary. 6. This Court perused the anticipatory bail order of other co-accused 2025:JHHC:12349 2 persons vide order dated 11.11.2024 in ABA No.6314 of 2024 and vide order dated 18.11.2024 in ABA No.6605 of 2024 and case diary including the confessional statement of two co-accused persons and seizure list also. 7. This Court finds some force in the submission advanced by learned counsel for the petitioner. 8. Considering the totality of aforesaid facts and circumstances, this Court is inclined to reconsider the prayer of anticipatory bail and extend the privilege of anticipatory bail to the petitioner. 9. Accordingly, petitioner, above named, is directed to surrender before the learned trial Court within four weeks from the date of receipt of a copy of this order and the learned trial Court on his surrender, shall release him on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Chatra in connection with Rajpur P.S. Case No.42 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Arun Kumar Rai, J.) R. Kumar/Suman
