This is the first bail application filed by the applicant under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of bail as he has been arrested in connection with Crime No. 20/2022, registered at Police Station Masturi, Distt. Bilaspur (C.G.) for offence punishable under Sections 395, 120B, 455, 147, 397, 412 of the Indian Penal Code and Sections 25 and 27 of the Arms Act. 2. As per the prosecution story, on 13.01.2022 at about 11.30 am, six persons entered into the house of the complainant and on the point of gun BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2025.12.10 11:06:11 +0530 2 and knife, they robbed gold and silver ornaments worth Rs.1,40,000/- and cash of Rs.2,48,000/-. Based on the above facts, present crime was registered against unknown person. During the course of investigation, four accused persons were arrested and charge sheet was filed against them. Thereafter first supplementary charge sheet was filed against two persons namely Ramjan @ Bablu and Jeet Prasad and second supplementary charge sheet was filed against present applicant Ramjan Ali @ Balla for aforesaid offence. 3. Learned counsel for the applicant submits that charge sheet has been filed against 07 accused persons. The applicant has been implicated only on the basis of memorandum statement and recovery of Rs.800/-. He further submits that 04 co-accused persons have already been granted bail by the Coordinate Bench and the applicant is in jail since 04.04.2023 and charge sheet has been filed and conclusion of the trial is likely to take considerable time, hence, present applicant may be enlarged on bail. 4. Learned counsel for the State while opposing the bail application would submit that in the test identification parade, the applicant has been identified by the complainant. She further submits that there are 06 criminal antecedents reported against the applicant, hence, his bail application may be rejected. 5. I have heard learned counsel for the parties and perused the case diary of the case with utmost circumspection. 6. In the instant case, the applicant has been implicated only on the basis of alleged memorandum statement and recovery of Rs.800/-. In the present case, there are 07 accused persons, out of which, 05 of them have been granted bail. FIR was lodged against unknown persons. Though the complainant has identified the applicant in the TI parade, but recovery of only 3 Rs.800/- has been made from the applicant. Charge sheet has already been filed against the applicant. Having considered the aforesaid facts and circumstances of the case, I feel inclined to release the applicant on regular bail. 7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a bail bond for a sum of Rs.50,000/- with two sureties of the like sum to the satisfaction of the concerned trial Court. He shall be released on bail on the following conditions:- (i) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court, (ii) He shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
