This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 08/2025 registered at Police Station – Police Station Rang Cyber District – Bilaspur (C.G.) for the offences punishable under Sections 61, 317(5), 318(4), 111(3)(4), 323 of the BNS. 2. The prosecution's case, in brief, is that, the applicant was earlier employee of the Seven Pherery Matrimonial which situated at Ward No. 2, Batalion Road, Sakari Bilsapur. The said institution is a marriage bureau office and the owner of the office is Sanat Kumar and the registration of the proprietor firm is registered in the name of Sanat Kumar. The registration certificate has also been issued by the Labour Department State of CG and also issued by the Govt. of India, Micro Small and Medium Enterprises in the name of Sanat Kumar. That the on 13.02.2025 FIR lodged by the Sub Inspector rang cyber P.S. Bilaspur District Bilaspur on the basis of the letter dated 27.10.2024 and subsequently after investigation in respected of the mule accounts as per direction of the portal of the Govt. of India and subsequently found of that total deposited amount Rs. 97,83492/- in total 82 accounts. 3. The applicant submits that she is innocent and has been falsely implicated in the present case. He further submits that the applicant name does not appear in the FIR dated 13.02.2025 lodged by the complainant. It is submitted that Sanat Kumar, the owner of Seven Pherery Marriage Bureau, has himself stated before the trial Court in his bail application that the entire amount belongs to him and no other person or employee is involved.
Further, the report submitted by the Officer In-charge of the Cyber Cell does not mention the name of the applicant, nor does it contain any specific allegation against her. The applicant has knowledge that another accused, during his statement before the Police Station, took her name, though no role of the applicant is evident in the entire case, and no complaint has ever been made against her. Even the owner has admitted that the said amount is his self-earned income. The applicant is ready to
3 abide by all conditions that may be imposed by this Hon’ble Court, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, the learned State Counsel opposes the bail application, submitting that the applicant was earlier employed with Seven Pherery Matrimonial, a firm owned and registered solely in the name of Sanat Kumar. An FIR was lodged on 13.02.2025, and during investigation conducted as per the Government of India portal’s directions regarding mule accounts, Rs.97,83,492/- was found deposited in 82 accounts. It is further submitted that the co-accused’s anticipatory bail has already been rejected by this Court. therefore, he is not entitled to grant anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the allegations, and the material available in the case diary, it appears that the applicant was earlier employed with Seven Pherery Matrimonial, situated at Ward No. 2, Battalion Road, Sakari, Bilaspur, which is a marriage bureau owned and registered solely in the name of Sanat Kumar, as reflected from the registration certificates issued by the Labour Department, State of Chhattisgarh, and the Ministry of Micro, Small and Medium Enterprises, Government of India.
An FIR was lodged on 13.02.2025 by the Sub-Inspector, Cyber Police Station, Bilaspur, on the basis of a letter dated 27.10.2024, relating to suspected cyber fraud activities, and during investigation conducted as per the directions of the Government of India portal regarding mule
4 accounts a total amount of Rs.97,83,492/- was found deposited across 82 accounts. In view of the nature of the investigation, the seriousness of the alleged cyber fraud and financial irregularities, and the applicant’s association with the said institution, this Court is not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Heerakali Yadav @ Sakshi, involved in Crime No. 08/2025 registered at Police Station – Police Station Rang Cyber District – Bilaspur (C.G.) for the offences punishable under Sections 61, 317(5), 318(4), 111(3)(4), 323 of the BNS, is rejected.
