1. The petitioner has prayed for following reliefs by way of this writ petition:-
“10.1 That, this Hon'ble Court may kindly be pleased to call the records pertaining to the case from the respondent authorities. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the Digitally signed by SHAYNA KADRI
2 respondent authorities to consider and decide the pending representation of the petitioner for grant of revised pay scale as per recommendation of D.N. Tiwari Commission and for symbolic calculation of revised pay scale with effect from 01.01.1996, within stipulated time, in accordance with law. 10.3 To kindly grant any other relief which may be deem fit in the given facts and circumstances of the instant case.”

The case, as presented, the petitioner is employed as a Lab Technician under respondent No. 1 and is presently posted at Rog Anveshan Prayogshala, Bilaspur (C.G.), where he has been performing his duties sincerely and without any complaint. An anomaly in the pay scale of Lab Technicians working under the respondent department was identified and examined by a committee headed by D.N. Tiwari, which, after verification, recommended rectification and grant of a revised pay scale. Despite these recommendations, the petitioner’s representations dated 07.02.2018 and 06.02.2023 seeking implementation of the revised pay scale and symbolic calculation thereof from 01.01.1996 have not been decided by the respondent authorities, leading to the filing of this petition.

Learned counsel for the petitioner submits that the continued inaction of the respondent authorities in not granting the petitioner the benefits of the revised pay scale, despite clear recommendations, is arbitrary, perverse, and bad in law. It is argued that the pay anomaly affecting Lab Technicians was duly examined by the committee headed by D.N. Tiwari, which verified and rectified the anomaly and recommended extension of the revised pay scale. However, despite such rectification, the petitioner has not been granted the consequential benefits from the
3 date of entitlement. Learned counsel for petitioner further submits that the petitioner made detailed representations on 07.02.2018 and again on 06.02.2023 seeking revision of his pay and symbolic calculation thereof with effect from 01.01.1996, but no decision has been taken till date, compelling the petitioner to approach this Court.
4. On the other hand, learned State counsel submits at the outset that the petition, as framed, is devoid of merit and deserves dismissal. It is contended that the petitioner’s representations have already been duly considered by the competent authorities, and the benefits of the revised pay scale with effect from 01.01.1996 have been extended to him vide orders dated 12.07.2019, and 21.12.2023 issued by the Joint Director, Veterinary Services, Bilaspur (C.G.). It is further submitted that the petitioner has also been granted the third higher pay scale with effect from 13.03.2023. In view of the benefits already accorded, the State asserts that the present petition has become infructuous and warrants dismissal.

At this stage, learned counsel for the petitioner submits that although certain benefits have now been extended to the petitioner, he has been deprived of the monetary advantages of the revised pay for a prolonged period without any justification. Therefore, at this stage, the petitioner may kindly be permitted to file an appropriate application seeking interest on the delayed payment of such benefits, as the petitioner is legally entitled to be compensated for the undue delay.
6. I have heard learned counsel for the respective parties and perused the documents annexed along with the petitioner with atmost circumspection.

7. On the basis of the pleadings and the submissions advanced by
learned counsel for both sides, it appears that the petitioner’s prayer for grant of revised pay scale in terms of the recommendations of the D.N. Tiwari Committee has already been duly considered by the respondent authorities. The record indicates that the petitioner has been extended the benefit of the revised pay scale with effect from 01.01.1996 vide orders dated 12.07.2019 and 21.12.2023.
8. In view of the fact that the reliefs claimed by the petitioner stand substantially granted, nothing further survives for adjudication in the present writ petition, and the same is accordingly disposed of.
9. However, the petitioner shall be at liberty to file an appropriate application before the competent authority seeking interest on the delayed monetary benefits, which may be considered in accordance with law. Sd/- (Amitendra Kishore Prasad) Shayna JUDGE
