CRM (M) 2520 of 2025
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Thanarpara Police Station Case No. 249 of 2025 dated 11.08.2025 under Sections 109/118(2)/329(3) of the BNS, 2023;
And In the matter of : Naju Mondal
……Petitioner.
Mr. Soumya Basu Roy Chowdhury
Mr. Abdul Aziz Mondal
……for the Petitioner.
Mr. Ranabir Roy Chowdhury
Ms. Rajarshi Tah
……for the State.
Learned advocate appearing for the petitioner submits petitioner is in custody for 114 days, charge sheet has already been submitted and the petitioner is the sole accused. Learned advocate submits that on any stringent condition petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the injuries complained of are of grievous nature and 12 stitches had to be administered on the victim. Be that as it may, having considered the period of detention and the gravity of the offence, I direct the learned Trial Court to release the petitioner after overcoming the stage
2 of consideration of charges on such terms and conditions as he deems fit and proper. With the aforesaid observations CRM (M) 2520 of 2025 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
