1. This is the second bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.175/2023 registered at Police Station – Basantpur, District – Balrampur- Ramanujganj, Chhattisgarh for the offences punishable under Section 302 of the Indian Penal Code, 1860.
2. After arguing at length, learned counsel for the applicant submits that at this stage, he is not pressing this application on merits. However, he submits that since the applicant is in jail since 23.11.2023, learned Trial SHUBHAM DEY Digitally signed by SHUBHAM DEY
2 Court be directed to expedite the trial. He also contended that till now, only 11 witnesses out of 22 witnesses have been examined.
3. In view of the submissions made by counsel for the applicant, this bail application is dismissed as withdrawn. However, taking note of the pre- trial detention of the applicant, learned Trial Court is directed to expedite the trial and take all necessary steps for causing presence of the prosecution witnesses as provided under the B.N.S.S., 2023.
