Learned counsel for the petitioner has fairly conceded that the controversy in the instant matter is no more res-integra as the same is already adjudicated by the Co-ordinate Bench of the Court at Principal Seat, Jodhpur in S.B. Considering the foregoing facts and circumstances, this Court deems it apposite to decide the instant matter in light of Rajesh Sharma (supra). Accordingly, the present petition is disposed of. Pending applications, if any, shall stand disposed.
