The parties to the lis have amicably resolved their dispute before the Lok Adalat and to that effect, they have filed joint memo of settlement. The terms of settlement read as under: 1. The WP filed against the award in KID No.145/2012 dated 21-01-2014 on the file of the Labour Court Hubballi, is set aside. 2. The removal order bearing No.VAKARASA/ GAVI/ SIBBANDI / GAIHA/823(09) 3849 dated 25-06-2012 has been settled between the parties on the following terms and the award may kindly be modified as under: 3 3. The Petitioner / Corporation has agreed to take the Respondent into service as a fresh as a trainee from the date of reporting, training will be for 2 years. 4. The Respondent to be placed on probation for a period of 2 years on completion of 2 years of training. 5. The Petitioner / Corporation agreed to take the Respondent into service as fresh as a trainee within four months from the date of receipt of this order. 6. The period of service rendered by the employee / trainee prior to the order of removal would not be considered for any purpose. 7. The Respondent Workman shall forego the award amount in App.No14/2017 by the District Court Gadag and interest thereon. 8. The settlement is arrived without prejudice to the contention taken by the Petitioner/Corporation that trainee is not a workman under the provision of I D Act. and the said issue is kept open to be decided in appropriate cases. 9. That the contents of this joint memo are read over and explained to the Respondent in Kannada language and same are true and correct and biding on the both the parties. 10. The Petitioner / Corporation and Respondent on their free wish and will agreeing for the terms and conditions of this joint memo have signed the joint memo. 3. The joint memo of settlement is placed on record. In terms of joint memo, the 4 petitioner/Management is directed to take the respondent/workman into service as a fresh trainee within four months from the date of receipt of certified copy of this order. The respondent would be placed on probation for a period of two years on completion of two years of training. The respondent would not be entitled for any award as awarded in Application No.14/2017 by the District Court, Gadag. Respondent’s prior service would not be considered for any purpose. 4.
